These conditions will supersede any terms and/or conditions you include with any purchase order, regardless of whether this store signs them or not. LED Light Expert reserves the right to make changes to this site and these conditions at any time.


Governing Law and Exclusive Jurisdiction
These Terms and Conditions shall be governed by and construed exclusively in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that any and all disputes, claims, or causes of action arising out of or relating to these Terms and Conditions, use of the website, or related to transactions with LEDLightExpert shall be resolved exclusively in the federal or state courts located in San Diego County, California. You irrevocably consent to the exclusive jurisdiction and venue of these courts and waive any objections to such courts' jurisdiction, venue, or inconvenient forum.


Compliance with Local Building Requirements
The Customer is solely responsible for ensuring that all Products purchased comply with all applicable local, state, and federal building codes, regulations, and standards in the location where they will be installed. While LEDLightExpert may, from time to time, provide basic support or general information regarding local standards, such assistance is provided as a courtesy and does not constitute professional advice. LEDLightExpert disclaims all liability for any non-compliance with building requirements, and the Customer assumes all responsibility and risk associated with the use and installation of the Products.


Regional Electric Demand Savings
Purchaser assigns the rights to offer any electric demand savings achieved through this project into the regionally relevant capacity market to LED Light Expert


Non Credit Card Orders Additional Payment & Agreement Terms



Attorney’s Fees:
 
In the event of any legal action by the parties arising out of orders placed with LEDLightExpert.com, the prevailing party shall be entitled to recover reasonable attorney's fees, court costs, and all expenses even if not taxable as court costs (including, without limitation, all such fees, costs, and expenses incident to appellate, bankruptcy, and post-judgment proceedings), incurred in that action or proceeding, in addition to any other relief to which such party may be entitled.
 

Outstanding and Past Due Balances:

In the event of an outstanding balance being owed by a customer, we will make reasonable efforts to notify you of the outstanding balance and provide you with an opportunity to pay. By agreeing to these Terms & Conditions, you understand and accept that failure to resolve an outstanding balance may result in charges to your credit or debit card without further notice. By using our services and providing us with your credit or debit card information, you hereby authorize us to charge any outstanding balance owed to us to any credit or debit card you have provided to us, whether previously or in the future. This includes, but is not limited to, charges related to non-payment, returned items, or any other situation resulting in a balance owed to us. We reserve the right to employ all legal methods available to enforce this agreement, which may include charging any credit or debit card provided by the customer, the filing of liens, obtaining collection agency assistance, and taking legal action. All costs associated with such actions will be the responsibility of the customer.
